Welcome to AppVibezz. These Terms of Use ("Terms") govern your access to and use of our website, SaaS platform, and mobile analytics software development kit (the "SDK") provided by AppVibezz.

1. Agreement to Terms

By creating an account, accessing our dashboard, or integrating our SDK into your mobile applications, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity. If you do not agree to these Terms, you must not access or use our services.

2. Company Information

3. Licenses and Scope

SaaS License: Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our SaaS analytics dashboard solely for your internal business operations.

SDK License: We grant you a non-exclusive, non-transferable, revocable license to embed and distribute the AppVibezz SDK inside your mobile applications solely to collect app telemetry, subscription statistics, and usage events for analysis via the AppVibezz SaaS Platform.

4. Account Registration and Security

To use our platform, you must register for an account. You agree to provide accurate, complete information and keep it updated. You are solely responsible for maintaining the confidentiality of your account credentials (API keys, passwords) and for all activities that occur under your account. You must notify us immediately at info@appvibezz.com of any unauthorized use or security breach.

5. Use Restrictions

You agree not to:

• Reverse engineer, decompile, or disassemble the AppVibezz SDK, except to the extent permitted by law.
• Use the SDK or SaaS platform to track, collect, or upload any personally identifiable information (PII) of End Users without obtaining appropriate consents and disclosures.
• Bypass, circumvent, or disable any security or quota-limiting features of the API or platform.
• Use the service for any illegal purposes or in violation of Google Play Developer Policies or Apple App Store Guidelines.

6. Subscription Plans, Fees, and Payment

Fees: Access to certain premium features of the SaaS Platform is subject to subscription fees detailed on our pricing page. You agree to pay all applicable fees in a timely manner.

Billing & Renewal: Subscriptions are billed in advance on a recurring monthly or annual basis and will automatically renew unless cancelled before the renewal date.

Taxes: All fees are exclusive of value-added tax (VAT) or other local taxes unless stated otherwise. Turkish corporate taxes or relevant local transactional taxes will be computed during checkout.

Refunds: Payments are non-refundable except as required by law or as expressly set out in a written agreement.

7. Privacy and End-User Consents

Because you use the AppVibezz SDK to track End-User data (such as advertising IDs, app events, and purchases), you must maintain a clear, legally compliant privacy policy on your mobile applications.

You represent and warrant that you have obtained all necessary disclosures, consents, and permissions from your End Users as required by applicable laws (such as GDPR, CCPA, and KVKK) to allow us to collect and process their usage telemetry on your behalf.

8. Intellectual Property Rights

Aloha Dijital Bilişim Eğitim ve Danışmanlık A.Ş. retains all right, title, and interest, including all intellectual property rights, in and to the AppVibezz website, SaaS Platform, SDK, and all related documentation, marks, and code. No licenses are granted except as explicitly stated in these Terms.

9. Disclaimers and Warranties

THE SAAS PLATFORM AND SDK ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ALOHA DIJITAL BILIŞIM EĞITIM VE DANIŞMANLIK A.Ş. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALOHA DIJITAL BILIŞIM EĞITIM VE DANIŞMANLIK A.Ş. BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR USE), ARISING OUT OF OR IN CONNECTION WITH THESE TERMS. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Suspension and Termination

We reserve the right to suspend or terminate your account and API access immediately, with or without notice, if we believe you are in breach of these Terms, failing to pay subscription fees, or engaging in activities that cause harm to our infrastructure or other users.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Courts and Execution Offices of Istanbul (Anadolu/Maltepe), Turkey.

13. Changes to Terms

We may modify these Terms from time to time. We will notify you of any material changes by posting the updated terms on our website or sending an email. Your continued use of AppVibezz after the posting of changes constitutes your acceptance of the revised Terms.
